Terms of Service

These Terms of Service ("Terms") are an agreement between you and Atmotos LLC ("Atmotos", "we", "us", or "our"), governing your use of our website and related services (the "Service"). These Terms apply when you activate an account after being shown these Terms or use the authenticated Service after receiving notice of them. Requesting waitlist access does not by itself mean you accept these Terms.

Eligibility

You must be at least 18 years old and legally able to enter this agreement to create an account or use the authenticated Service.

Access and invitations

The Service may be invite only while it is being developed. Requesting access does not guarantee an account. We may grant, limit, or decline access, subject to applicable law.

Your account

You are responsible for the information you provide, for keeping your login credentials secure, and for activity under your account. Notify us promptly if you suspect unauthorized use.

Your content and privacy choices

You retain ownership of the photos, vehicle information, posts, and other content you add ("Your Content"). You grant us a non-exclusive, worldwide, royalty-free license to host, reproduce, process, resize, display, and distribute Your Content only as needed to operate the Service and honor the visibility choices you make. We may allow our service providers to exercise this license only as needed to provide the Service for us.

Photos and profiles are private by default. If sharing features become available, content becomes visible to others only when you deliberately choose to share it. Before sharing a photo, review it for license plates, faces, locations, or other details you may not want visible. You represent that you have the rights and permissions needed to add and share Your Content.

The license ends when Your Content is deleted, except for residual backup copies and limited retention required for security, disputes, or legal compliance. Service and maintenance records remain private to your account and are not shared with other users.

Acceptable use

You agree not to:

• Use the Service for an unlawful, harmful, or fraudulent purpose.
• Add or share content that infringes intellectual-property, privacy, or other rights.
• Share nonconsensual intimate imagery or another person's private information without permission.
• Threaten, harass, impersonate, or deliberately deceive others.
• Disrupt the Service, gain unauthorized access, or reverse engineer it, except where applicable law permits that activity.
• Scrape or harvest data from the Service without permission.

Moderation

We may restrict access to or remove content that we reasonably believe violates these Terms, applicable law, or the rights or safety of others. When practical, we will provide notice and a reasonable opportunity to correct a violation. We may act without advance notice when urgent safety, security, legal, or abuse concerns require it.

Our intellectual property

The Service, excluding Your Content, includes software, design, and branding owned by Atmotos or its licensors and protected by intellectual-property laws. These Terms do not grant rights to our names, logos, or proprietary materials except as needed to use the Service.

Third-party content and services

The Service may display links, news, or images provided by third parties. We do not control or endorse third-party services, and their terms and privacy practices apply when you use them.

Vehicle records and safety

The Service helps you organize information you provide. It is not a substitute for manufacturer instructions, recall notices, inspections, or advice from a qualified mechanic or other professional. You are responsible for verifying important vehicle and safety information.

Account deletion and termination

You may stop using the Service and request complete account deletion by emailing admin@atmotos.com. After we verify the request, we remove account content from active systems and remove public visibility. Residual copies expire through our normal backup cycle, subject to limited security, dispute, and legal retention.

We may suspend or terminate access for a material violation of these Terms or to protect the Service and its users. When practical, we will provide notice and an opportunity to correct the problem first.

Disclaimers

To the extent permitted by law, the Service is provided “as is” and “as available.” We do not guarantee uninterrupted, secure, or error-free operation or that user-entered records will be complete. Keep independent copies of information that is important to you. Nothing in these Terms excludes a warranty or right that applicable law does not allow us to exclude.

Limitation of liability

To the extent permitted by law, Atmotos will not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of data arising from your use of the Service. This limitation does not apply to fraud, gross negligence, willful misconduct, or liability that applicable law does not allow us to limit.

Changes to these Terms

We may update these Terms as the Service changes. We will post the new effective date and provide reasonable notice through the Service or by email before a material change takes effect when practical. Changes apply prospectively. Continuing to use the Service after the effective date means you accept the updated Terms.

Governing law

Texas law governs these Terms without regard to conflict-of-laws rules, except that mandatory protections under the law where you live still apply when they cannot legally be waived.
